b g  EROS was fractious while being saddled and injured itself.  Under the circumstances the gelding was withdrawn under veterinary grounds.  Tr. D M David was informed not to accept with his charge until certified fit by the Veterinary Officer.

 

The Stewards held an enquiry immediately after running of the race with particular reference to the interference received by b g BLUE MOUNTAIN in the final 300 metres of the race. 

 

An objection was lodged by Jockey Vinay Jaiswal, the rider of BLUE MOUNTAIN placed 4th by the Judge against Jockey Melvyn Maseyk, the rider of REQUITE placed 2nd by the Judge on the grounds that “he took me out from the 300 metres to the outer portion of the railing and I lost the race”.  The Stewards after having interviewed both Jockeys, Stipendiary Stewards and after viewing the CCTV replay of the race, unanimously  resolved to :

 

a)       Up-hold the objection.

 

b)       Disqualify b m REQUITE from the race.

 

c)      Revise the Judge’s placings  as under :-

 

ARISEN STAR-           1st

AGNATION    -           2nd

BLUE MOUNTAIN     -           3rd

LITTLE JADEN           -           4th

PINE VALLEY-           5th

 

d)     Hoist ‘the All Clear’ signal.

 

The Stewards continued with the enquiry after the last race and charged Jockey Melvyn Maseyk under Rule 161(i) for Dangerous Riding in that  during the final 300 metres of the race when in clear running he made no attempt to keep his mount b m REQUITE on a straight path thereby allowing the mare to drift ‘outwards’ and cause severe interference to b g BLUE MOUNTAIN (Vinay Jaiswal) which was making progress on its outside.   Mr. Maseyk when afforded an opportunity pleaded guilty to the charge of dangerous riding.  The Stewards when deciding on the penalty took into consideration the record of the jockey, mitigating circumstances and decided to suspend Jockey Melvyn Maseyk from riding in races from 6th March to 31st March, 2012 (both days inclusive).  The jockey was informed of his right to appeal and was permitted to ride track work.
