b g FLIGHT OF PHOENIX was examined by the Veterinary Officer behind the starting gates and was found to be lame on right fore. Under the circumstances the gelding was permitted to be withdrawn on veterinary grounds. Tr. Narendra Lagad was informed not to accept with the gelding until certified fit by the Veterinary Officer. Jockey Nelson Maseyk, the rider of TIBIDABO, was fined a sum of Rs. 1,000/- for presenting himself to the parade ring without his body protector. An enquiry was held immediately after this race into the running and riding of b g TIBIDABO, ridden by Jockey Nelson Maseyk and trained by Mr. Vikash Jaiswal. The matter was referred to the Stewards who met after the last race wherein Trainer Mr. Vikash Jaiswal was charged for violating Rule 159(a) i.e., every horse shall be run on its merits whether his owner runs another horse in the race or not and Jockey Mr. Nelson Maseyk was charged for violating Rule 159(b) i.e., the rider of every horse shall take all reasonable and permissible measures throughout the race to ensure that his horse is given full opportunity to win or to obtain the best possible place in the field, in that during the final 400 metres of the race when in clear running the jockey had failed to ride his mount to complete advantage. The Stewards noted the following :- 1. The statements of Mr. Nelson Maseyk that :- a) He was instructed to place his mount in 3rd/4th position and to do his best in the straight. b) Not to use the whip on the gelding as it hangs ‘in’ and ‘out’ under the whip. c) He had ridden to the best of his ability. When queried if he had been given instructions as to how the gelding should be ridden by anyone other than the trainer, Jockey Nelson Maseyk stated that :- a) He takes instructions only from the Trainer. 2. The statements of Trainer Mr. Vikash Jaiswal that :- a) He had instructed the Jockey to settle the gelding with the field on jumping out from the gates and to do his best but not to use the whip as the horse is inclined to drift ‘out’ under its use. b) He was “not satisfied” with the riding of the Jockey and was of the opinion that the gelding could have performed much better had the jockey been more vigorous in his riding and described the riding as a ‘soft’ ride. c) Even on previous occasions when he had been taken to task for the questionable running of his charges which had been ridden by the same jockey, he had always instructed Jockey Nelson Maseyk to do his best, but, for some reason the Jockey had repeatedly failed to follow his instructions. When queried by the Stewards as to why he has been repeatedly declaring Jockey Nelson Maseyk to ride his charges in spite of him not riding to his instructions, the trainer stated that :- a) He has been declaring Mr. Nelson Maseyk to ride some of his charges on the instructions of the owner. The Stewards after due deliberations found Jockey Nelson Maseyk guilty of preventing b g TIBIDABO from running on its merits and after taking into account the Jockey’s records decided to declare Jockey Nelson Maseyk as a ‘disqualified person’ with effect from 1st July, 2017 to 31st October, 2017 under Rule 202(xiii) of the RCTC Rules of Racing. Mr. Nelson Maseyk was informed of his right to appeal. Further, the Stewards informed trainer Mr. Vikash Jaiswal that :- a) As a licensed trainer under the Rules of the Club, it was his responsibility to ensure that professionals and others associated with his stable do not breach the Rules of Racing. b) His disciplinary record reads alarmingly. c) However, he was being given the benefit of doubt in this instance. |
