STAR PRINCE (T.S.Jodha) was reluctant to be reach the start and had to be sent in the opposite direction. Trainer Vinayak has been asked to school his charge to proceed to the start before next accepting with him to race. JEN’S GLORY (App.A.Sandesh) was restless in the stall, not allowing the rider to settle. Trainer Altaf Hussain has ben asked to give the filly more gate practice and show her to the satisfaction of the Starter at morning starting trials, before next accepting to race. Near 300 metres, FREANY (P.S.Chouhan) clipped the hind heels of OCEAN OF FAITH (D.K.Ashish) and stumbled. Trainer Vinayak and Jockey I.Pasha were questioned with regard to the running and riding of MOONLIGHT BEAUTY. The instructions to the Jockey were to be in 4th or 5th position and to ride out hands and heels in the straight as the filly does not like whip. It was observed that Jockey I.Pasha had not ridden out the horse vigorously in the straight, as such the matter was reported to the Stewards for such action as deemed fit. The Stewards after the last race, interviewed Trainer Vinayak and Jockey I.Pasha in the above connection and having heard the submissions made and having viewed the video recording of the race, the Stewards were not satisfied with the explanation tendered by Jockey I.Pasha and held him guilty of unsatisfactory riding on his mount. In that, early part of the race he sat behind and kept tracking the stable mate STAR PRINCE and after entering the straight he allowed STAR PRINCE to take the lead and thereafter switched his mount to the outside and he was not vigorous in his riding effort throughout the straight. Therefore, the Stewards decided that should he apply for a Jockey’s license for the Season 2011/12, the same will be granted to him, however, his Jockey’s license shall stand suspended w.e.f. 21st July, 2011 to 28th August, 2011(both days inclusive) for unsatisfactory riding on his mount MOONLIGHT BEAUTY (Not permitted to ride work/mock race). Further, the Stewards were also not satisfied with the explanation tendered by Trainver Vinayak in the subject case and held the view that the Jockey would not have ridden in this manner unless he had the Trainer’s tacit approval. Therefore the Stewards decided to fine Trainer Vinayak a sum of Rs.25,000/- for unsatisfactory running of his charge and to severely warn him for the future. Two Objections were lodged in this race. First objection was lodged by App.A.Sandesh, the rider of JEN’S GLORY (Placed 4th) against Jockey T.S.Jodha, the rider of STAR PRINCE (Placed first). The reason being that at about 200 metres, STAR PRINCE shifted in and bumped his horse twice whereby he was unbalanced and could not do justice to his mount. The second Objection was lodged by Jockey S Sunil, the rider of BLUE MELLON (Placed 2nd) against Jockey T.S.Jodha, the rider of STAR PRINCE (Placed first). The reason being that at around 450 metres, STAR PRINCE shifted out and came on to GOLDEN SPURS who in turn came on to him. Thereafter, again at 350 metres STAR PRINCE bumped him and his horse got unbalanced and at 150 metres, STAR PRINCE bumped his horse again and unbalanced him whereby he could not ride out his mount and this cost him the race, the verdict being half length. After considering the submissions made by the Jockeys concerned, in conjunction with that of the Stipendiary Stewards and relying on their judgment, the Stewards decided to over-rule both the objections. The Stewards after the last race interviewed Jockey T.S.Jodha in the above connection and having heard the submissions made and having viewed the video recording of the race, the Stewards were not satisfied with the explanation tendered by him and held him guilty of careless riding on his mount STAR PRINCE in the above race. Therefore, the Stewards decided that should he apply for a Jockey’s license for the Season 2011/12, the same will be granted to him, however, his Jockey’s license shall stand suspended w.e.f. 21st July, 2011 to 29th July, 2011 (both days inclusive) (permitted to ride work/mock race). The Sr.V.O. reported that MOONLIGHT BEAUTY was examined at the stables at 0800 hours the next morning i.e. on 11th April, 2011 and was found to be sore by the right fore leg with swelling on the right knee. The filly has to be passed fit by the Club’s V.O. before next accepting to race. The Sr.V.O. reported that CHINGARI was examined at the stables at 0815 hours the next morning i.e. on 11th April, 2011 and was found to be sore by the left fore leg. The mare has to be passed fit by the Club’s V.O. before next accepting to race. After the race, FREANY & STAR PRINCE were found to be sound.
RE : APPEAL FROM TRAINER VINAYAK IN RESPECT OF THE FINE OF RS.25,000/- IMPOSED ON HIM BY THE STEWARDS OF THE CLUB FOR UNSATISFACTORY RUNNING OF HIS CHARGE “MOONLIGHT BEAUTY” IN RACE NO.329 – THE JEHAN NUMA PLATE RUN ON 10TH APRIL, 2011 : The Board of Appeal at its Meeting held on 10th July, 2011 whilst considering all documents and papers that were submitted including the Grounds of Appeal, noted that the certificate of the Club’s Veterinary Officer in respect of MOONLIGHT BEAUTY submitted along with the Grounds of Appeal was not part of the proceedings of the enquiry before the Stewards of the Club and therefore considered the certificate to be fresh evidence. The Board of Appeal therefore decided to remand the case back to the Stewards of the Club in accordance with the Rules of Racing of the Club. In the mean time the punishment meted out to Trainer Vinayak by the Stewards of the Club was stayed and the deposit was ordered to be refunded. ENQUIRY INTO THE RUNNING AND RIDING OF MOONLIGHT BEAUTY IN RACE NO.329 – THE JEHAN NUMA PLATE RUN ON 10TH APRIL, 2011 –MATTER WAS REMAINDED BACK TO THE STEWARDS OF THE CLUB BY THE BOARD OF APPEAL DUE TO FRESH EVIDENCE :
The Stewards of the Club at their meeting held on Thursday, 28th July, 2011 interviewed Trainer Vinayak and Jockey I.Pasha in reference to the captioned subject matter. 1) The Stewards noted that in the enquiry held into the running and riding of MOONLIGHT BEAUTY after the races on 10th April, 2011 the Stewards took objection to Jockey I.Pasha’s riding in the early part of the race as also not riding out vigorously in the straight. At no stage in the said enquiry did Trainer Vinayak or Jockey I.Pasha state that the horse was hanging or changing legs or was uncomfortable in the race, In fact, Jockey stated that he rode the horse as instructed by the Trainer and had ridden out the horse and done his best and Trainer Vinayak stated that he was satisfied with the Jockey’s riding and this was the best run of the horse. If the horse had ducked in twice during the race and the Jockey felt something was wrong with the horse as claimed by him now, he should have brought the same to the notice of the Stipendiary Stewards immediately after the race or at the enquiry held by the Stewards the same evening, which neither he nor Trainer Vinayak did, therefore, the Stewards held the view that this was an after thought. 2) The Certificate from the Club’s Sr.V.O. submitted by Trainer Vinayak as evidence, to show that the horse had a chip fracture, pertains to the examination of the horse the next morning after the race. The review of the video recording of the race does not indicate that the horse was uncomfortable in the race and as per the report of the Clubs Sr.V.O. the horse had returned sound after the race and this was confirmed both by Trainer Vinayak and Jockey I.Pasha. In view of the stay granted by the Board of Appeal on the punishment imposed on Trainer Vinayak and Jockey I.Pasha, the Stewards decided :- a) that Jockey I.Pasha’s license shall now stand suspended w.e.f. 14th August, 2011 till 18th September, 2011 (both days inclusive) for unsatisfactory riding on his mount MOONLIGHT BEAUTY in Race No.329; b) to retain the fine of Rs.25,000/- imposed on Tr.Vinayak earlier for unsatisfactory running of his charge MOONLIGHT BEAUTY in Race No.329. Further, he was severely cautioned for the future. -------------------------
The Board of Appeal at its Meeting held on 14th August, 2011 considered appeal from Jockey I.Pasha against the above punishment imposed on him. The Board of Appeal interviewed Trainer I.Pasha and having considered all documents and papers that were submitted including the Grounds of Appeal and having heard the submissions made by Jockey I.Pasha and having deliberated on the matter at length and having applied their minds decided to reject the appeal and forfeit the deposit. |
