ORDER OF THE STEWARDS
FOURTH DAY, WEDNESDAY, 8TH JUNE, 2011

RACE NO.32: THE CHAMUNDI HILLS CUP (ABOUT) 1400 METRES. HORSES RATED 20 TO 45, 5 YEARS OLD AND OVER:
I.      b.m. BYZANTINE, trained by Mr. R Mallikarjuna and ridden by Jockey G Y Rajesh Babu, ran in Race No.32 of the Mysore Summer Races 2011, on the 8th of June, 2011.

II.     Immediately after the Race, b.m. BYZANTINE, was examined while being unsaddled by the rider at the unsaddling enclosure provided for the winner and the placed horses. At that moment, a stone from underneath the saddle from the base of the withers falling down was noticed and the stone was collected by the authorities. The horse was impounded for veterinary examination and subsequently, it was reported that a depressed bruised area was noticed at the base of the withers. The injury was fresh and the mare was flinching for mild palpation of the area.
III. In this connection, a detailed enquiry was held by the Stewards of the Mysore Race Club Limited after the last race on Thursday, the 9th of June, 2011. They examined Trainer Mr. R Mallikarjuna along with the Jamadar of Trainer Mr. G T Surender, Mr. Gulshan Sanowar, and the Syce (Spare Boy) of the horse, Mr. Dilshad Alam, and again, at their meeting, held on 15th June, 2011, after the last race, the Stewards examined Trainer Mr. R Mallikarjuna, along with Jamadar Mr. Gulshan Sanowar, Jockey G.Y. Rajesh Babu, Riding Boys, Mr. Mohd. Nazim & Mr. Saddam Hussain and one Syce, Mr. Dilip Kumar. After due examination, they decided to issue the following Charge Sheets to (a) Trainer Mr. R Mallikarjuna, (b) Jamadar Mr. Gulshan Sanowar, and (c) the Syce (Spare Boy) Mr. Dilshad Alam: 

(A)

Trainer Mr. R Mallikarjuna: 

CHARGE SHEET

        Contravention of Rule No.114(b)(i), read with Rule Nos.202, 202(i) and (xiii) of the BTC Rules of Racing in connection with the running of your charge, b.m. BYZANTINE in Race No.32 of the Mysore Summer Races 2011, i.e., The Chamundi Hills Cup (About) 1400 Metres, for horses rated 20 to 45, 5 years old and over, run on Wednesday, the 8th of June, 2011.

After thorough examination, the Stewards are of the opinion that you are guilty of contravening Rule No.114(b)(i), read with Rule Nos. 202, 202(i) and (xiii) of the BTC Rules of Racing in that:

  1. On your own admission, you were very much present when the horse was being saddled and that you failed to notice a stone being placed underneath the saddle at the base of the withers of the horse, purportedly by the Syce (Spare Boy) of the horse Mr. Dilshad Alam; (b) You had engaged the services of Jamadar Mr. Gulshan Sanowar, who, according to your own admission, is the Registered Jamedar of Trainer Mr. G T Surender, to saddle your charge when Trainer Mr. G T Surender himself had a runner in the above Race; and (c) Your gross negligence and neglect in the performance of your duties as a Licensed Trainer with regard to saddling of the horse BYZANTINE before the race has resulted in the horse running under sufferance materially affecting the performance of the said horse in the above said Race, which has ultimately culminated in an improper practice and dishonorable action being committed in relation to Racing in this particular Race.

      The Stewards in the light of the charge sheet issued once again examined Trainer Mr. R Mallikarjuna, Trainer Mr. G T Surender and Jamedar Gulshan Sanowar at their meeting held on Wednesday, 22nd June, 2011. After detailed deliberations and after concluding the enquiry as regards this matter, the Stewards decided as under:

I(a) on his own admission, trainer Mr. R. Mallikarjuna was very much present when the horse BYZANTINE was being saddled and that he failed to notice a stone being placed underneath the saddle at the base of the withers of the horse, purportedly by the Syce (Spare Boy) of the horse, Mr. Dilshad Alam;

(b) he had engaged the services of Jamadar Mr. Gulshan Sanowar, who, according to his own admission, is the Registered Jamadar of Trainer Mr. G T Surender, to saddle his charge when Trainer Mr. G T Surender himself had a runner in the above Race;

(c) his gross negligence and neglect in the performance of his duties as a Licensed Trainer with regard to saddling of the horse BYZANTINE before the above said race has resulted in the horse running under sufferance materially affecting the performance of the said horse in the above said Race, which has ultimately culminated in an improper practice and dishonorable action being committed in relation to Racing in this particular Race.

II. In view of the above, trainer Mr. R. Mallikarjuna was guilty of contravening Rule Nos.114(b)(i) read with Rule Nos.202, 202(i) & (xiii) of the BTC Rules of Racing.

  1. In the light of the above, the Stewards decided to suspend the Trainer’s Licence granted to Trainer Mr. R Mallikarjuna with effect from 12th July 2011, up to 3rd August, 2011 (both days inclusive), and further refer him to the Stewards of the Bangalore Turf Club Limited for further action as they deem fit, for contravention of Rule No. 114(b)(i) read with Rule Nos.202, 202(i) and (xiii) of the BTC Rules of Racing with regard to the saddling and running of his charge.
  1. BYZANTINE in Race No.32 of Mysore Summer Races 2011 held on Wednesday, 8th June 2011.

Jamadar Mr. Gulshan Sanowar: 

CHARGE SHEET

Action under Rule Nos.202, 202(i) and (xiii) of the BTC Rules of Racing with regard to running of b.m. BYZANTINE under the charge of Trainer Mr. R Mallikarjuna in Race No.32 of the Mysore Summer Races 2011, i.e., The Chamundi Hills Cup (About) 1400 Metres, for horses rated 20 to 45, 5 years old and over, run on Wednesday, the 8th of June, 2011.

After thorough examination, the Stewards are of the opinion that you are liable for action under Rule Nos.202, 202(i) and (xiii) of the BTC Rules of Racing in that during the course of the enquiry, you admitted having assisted Trainer Mr. R Mallikarjuna in saddling his charge, b.m. BYZANTINE, in the saddling enclosure prior to the Race when you, as a Registered Jamadar of Trainer Mr. G T Surender, who himself had a runner in the said Race, should not have gone to saddle the horse belonging to another Trainer other than your Master Trainer. Further having offered your service, you have been negligent in not properly supervising the saddling of the said horse in that the stone had been purportedly placed by the Syce (Spare Boy), Mr. Dilshad Alam, underneath the saddle of the horse BYZANTINE, which has resulted in the horse running under sufferance materially affecting the performance of the said horse in the above said race, which ultimately culminated in an improper practice and dishonorable action being committed in relation to racing in this particular race.

The Stewards in the light of the charge sheet issued once again examined Jamadar Mr. Gulshan Sanowar along with the Trainer Mr. R Mallikarjuna and Trainer Mr. G T Surender at their meeting held on Wednesday, 22nd June, 2011. After detailed deliberations and concluding the enquiry as regards this matter the Stewards decided as under:

I(a) During the course of the enquiry, Jamedar Gulshan Sanowar admitted having assisted Trainer Mr. R Mallikarjuna in saddling his charge, b.m. BYZANTINE, in the saddling enclosure prior to the Racing when he, as a Registered Jamadar of Trainer Mr. G T Surender, who himself had a runner in the said Race, should not have gone to saddle the horse belonging to another Trainer other than his Master Trainer and (b) Further, having offered his service, he has been negligent in not properly supervising the saddling and running of the said horse in that the stone had been purportedly placed by the Syce (Spare Boy), Mr. Dilshad Alam, underneath the saddle of the horse BYZANTINE, which has resulted in the horse running under sufferance materially affecting the performance of the said horse in the above said race, which, ultimately, culminated in an improper practice and dishonourable action being committed in relation to racing in this particular race.

II. In view of the above Jamedar Gulshan Sanowar was liable for action under Rule Nos.202, 202(i) & (xiii) of the BTC Rules of Racing.

III. In the light of the above, the Stewards decided to suspend Jamedar’s Licence granted to Jamadar Mr. Gulshan Sanowar with effect from 12th July 2011, up to 3rd of August, 2011 (both days inclusive), and further refer him to the Stewards of the Bangalore Turf Club Limited for further action as they deem fit, for contravention of Rule Nos. 202, 202(i) and (xiii) of the BTC Rules of Racing with regard to the saddling of BYZANTINE in Race No.32 of the Mysore Summer Races 2011 held on Wednesday, 8th June 2011.

Syce (Spare Boy), Mr. Dilshad Alam:

CHARGE SHEET

Action under Rule Nos.202, 202(i) and (xiii) of the BTC Rules of Racing with regard to running of b.m. BYZANTINE under the charge of Trainer Mr. R Mallikarjuna in Race No.32 of the Mysore Summer Races 2011, i.e., The Chamundi Hills Cup (About) 1400 Metres, for horses rated 20 to 45, 5 years old and over, run on Wednesday, the 8th of June, 2011.

After thorough examination, the Stewards are of the opinion that you are liable for action under Rule Nos.202, 202(i) and (xiii) of the BTC Rules of Racing in that during the course of the enquiry, you admitted having placed a stone underneath the saddle at the base of the withers of the horse BYZANTINE while being saddled before the race, which has resulted in the horse running under sufferance materially affecting the performance of the said horse in the above said race. The action of yours constitutes the fraudulent practice in terms of Rule No. 202(i)) of the BTC Rules of Racing.

The Stewards, in the light of the charge sheet issued, at their meeting, held on the 22nd of June, 2011, noted that the Syce (Spare Boy) of the horse, Mr. Dilshad Alam, was absconding after the enquiry held on the 9th of June, 2011 and had not presented himself before the Stewards for the enquiries held on 15th June 2011 and 22nd June 2011 despite prior intimation. After detailed deliberations, the Stewards decided as follows:

I. During the course of the enquiry, he (Dilshad Alam) admitted having placed a stone underneath the saddle at the base of the withers of the horse, b.m. BYZANTINE, while being saddled before the race, which has resulted in the horse running under sufferance materially affecting the performance of the said horse in the above said race and that the action of the Syce (Spare Boy) Mr. Dilshad Alam constituted the fraudulent practice in terms of Rule No.202(i) & (xiii) of the BTC Rules of Racing.

II. In view of the above, Syce (Spare Boy) Dilshad Alam was liable for action under Rule Nos.202, 202(i) & (xiii) of the BTC Rules of Racing.

III. In the light of the above, the Stewards decided to declare the Syce (Spare Boy), Mr. Dilshad Alam, as an excluded person under BTC Rules of Racing with effect from 12th July 2011, up to 3rd of August, 2011 (both days inclusive), and further refer him to the Stewards of the Bangalore Turf Club Limited, for further action as they deem fit for contravention of Rule No.202(i) and (xiii) of the BTC Rules of Racing with regard to saddling and running of BYZANTINE in Race No.32 of the Mysore Summer Races 2011, held on Wednesday, 8th June 2011.
