Mr Arun Jaitley, You Just Destroyed A Thriving Ind

I’m no expert economist and from what I understand, the new Goods and Services Tax is going to simplify our country’s direct taxation regime. What I do understand is the economics of the business of racing and breeding thoroughbred racehorses and the proposed GST of 28% set by the Government of India has pretty much set the seeds for the end of our sport which has rolled along in a haphazard way since 1777. To treat it simply as gambling isn’t just plain wrong it shows a complete lack of application on the part of the GST Council, the Finance Ministry, the Agriculture Ministry and the entire Indian Government. It clearly seems as if they think some horses turn up on the race track, they run and people just gamble on it, well Mr Jaitley it’s a lot more and I mean a hell of a lot more than that.

It’s pretty obvious the government hasn’t done its due diligence as to the effect such a high tax slab will have on the industry as a whole. Nowhere in the world are betting pools taxed as heavily as this and frankly speaking all this will do is to drive betting underground to illegal bookmakers and penalize the transparent totalizator system which is the norm in successful racing jurisdictions like, Japan, Hong Kong, France and USA. The three most heavily hit race clubs will be Bangalore, Hyderabad and Mysore as they are running very efficient tote setups and as a result paying their State Governments a handsome amount in turnover tax, the reason for this is that they were taxed within reason and they were able to pass this on to their customers who seeing a good return flocked to the tote instead of the bookmakers and as a result swelled the total pool. The beauty of this system is that every paisa bet is accounted for and the government collects its fair share of Tax without any evasion or hiding whatsoever, the entire amount bet goes into a computerized pool, whatever percentage has to be deducted is and the rest is distributed back to the public in winnings.

All other clubs will be hit as well since Indian racing is synergistic in nature and a drop in tote commissions would mean a drop in commission paid between clubs as well. Further to this it’s very obvious that the government hasn’t looked at the employment racing and breeding generates, when I say the industry provides about 50,000 jobs believe me that’s a low figure it’s probably a lot higher. Take the example of Dashmesh Stud Farm and our village, Sarainaga. My family are basically farmers if we were to plant the normal Wheat and Rice prevalent in the area, I’d employ no more than 20 people to work the entire farm, two tractor drivers and another 18 farm labourers.

Since we are involved in breeding horses we employ at the farm; 60 syces, 30 women who clean stables, 30 supervisory staff, such as office people, jamadars, farriers, etc. 6 tractor drivers, 20 farm labourers, 15 watchmen, 12 gardeners to look after the stud yard and estate, 2 full time electricians, 2 veterinarians and 4 compounders. Further to this we also hire daily wage workers on a regular basis, at any given time at least 20 of them at any given time involved in jobs like painting, putting away produce etc. Added to this we buy horseshoes which come from Bangalore and are manufactured by somebody. Veterinary medicines, vaccines, bandages, chemicals etc. which are also manufactured by somebody. My truck man Surinderpal makes at least 15 annual up and down runs to and from racecourses either delivering young-stock or picking up mares. We also buy bran from a mill where again people are involved in the manufacture of the same. We pick up rice straw and a separate team are contracted to bring in 600 trolleys annually. Other farms buy their fodder and oats too, we grow ours in house. All in all as you can see from my example the knock on effect of running a Stud Farm provides a huge amount of indirect employment as well. Consider the fact that this is one stud farm alone, there are other farms spread out all over India who certainly employ a lot more staff that we do. We give employment to the average Indian, the majority of whom the universal government education system has failed miserably. My employees are the ones that run the show and they have trained on the job to look after horses and believe me it’s a very valuable skill.

Now let’s talk about a race club, they employ people in the thousands all the way from Veterinarians, racing officials, jockeys, trainers, riding boys, farriers, tote operators, security personnel, gardeners, those people who replace divots after every race, drivers, doctors, nurses, jamadars, race book sellers and a lot of syces in many places one per horse, to put things in perspective Bangalore stables a thousand horses. Owners own horses and pay bills, one usually earns that money from stakes and it is paid as Basic Training Fee or in the case of trainers and jockeys commissions. All this money to run the show comes from the income that clubs get from their betting commission on the tote, BTC was taking 4% from the turnover to fund their racing and paying 8% on turnover as tax, when one factors in entertainment tax and service tax BTC was paying the Karnataka Government 11% in taxes. Now if that amount rises to the proposed 28% suddenly the tote pool shrinks and the punter gravitates towards the illegal bookie who pays 0% tax and pays nothing to the sport. Most of these syces and riding boys come from backward places like Bihar, Jharkhand, UP and the Marwar region of Rajasthan, they earn money and send it home to their families, so someone should tell Mr. Jaitley that the cascading effect of a 28% tax slab runs across a lot of places far far away from the,”Race Clubs.”
If clubs run their racing efficiently and earn money from betting which is whether one likes it or not the fuel that keeps our engines running, the cascading effect is a more robust market as higher betting turnover means better stake money and better remuneration for owners which makes owning horses viable. All a 28% tax will do is drive legal betting underground and as such cause a loss to the exchequer as well as the clubs that run the sport, they’ll continue running it in a meagre way instead and as has been proven time and again this causes owners and trainers to be more dependent on gambling rather than shooting for excellence to make ends meet.

The unfortunate thing is that the GST Council has failed to see empirical evidence available in India itself before coming to this decision of taxing Race Clubs at 28% on their betting. RWITC was paying a 20% tax to the Maharashtra Government, this is a ridiculous tax rate on horse betting the result was that the club was paying the state government well under 20 Crores annually. I can safely say that RWITC’s turnover that is lost to illegal betting easily runs to over a thousand crores. On the flip side was BTC who by running a successful totalizator based operation with a sensible tax rate of 4% was paying the Karnataka Government something in the region of Rs. 200 Crores annually. Now with 28% taken by the government and the club taking a commission the overall pool shrinks and a shrinking tote means misery for all involved, the club, the government and all connected dependents.
I’m pretty sure that those who have decided to fiddle with what is a very fine balancing act when it comes to revenue have never been to a racecourse or visited a stud farm ever. Worldwide breeding of horses is encouraged by governments and even subsidized as it provides jobs and it’s an environmentally cleaner option than any kind of intensive farming. Breeding horses means no using of pesticides on pasture, paddocks are pretty much left to grow naturally. Further breeding horses is a very viable and well paying animal husbandry option and it’s agricultural in every way. Without experience as a farmer any breeder would struggle, breeding horses is simply put a value added agricultural system.

One hopes that we as an industry for once get some relief. To start with the GST has taken over what ought to stay on as a state subject. Our Racetrack and Off Track Betting project in Punjab which was a straight up project worth Rs.600 Crores of Foreign Direct Investment and was going to bring at least 10,000 permanent jobs and a lot of welcome revenue for our cash strapped state is now dead in the water. No one in their right mind will invest in a racing project where the tax rate is 28%, the total take out from pools; which means government tax plus the club’s commission in no proper racing jurisdiction exceeds 20%. The Punjab Government as part of the project was going to earn between 5% and 10% as their cut. Well that’s all gone because people who scarcely understand our industry sit in judgment over it. Shame on you Indian Government, I didn’t know that the panacea that GST was promoted as is supposed to suck the guts out of an industry that few understand. You’re not creating any new jobs at least don’t destroy the ones that exist!

All concerned,well wishers of Indian Horse Racing and our honourable Government.

There should be no doubt, that 28% GST is bound to ultimately kill the most beautiful, most enjoyable,a grand sport and the game of extreme skills of Horse Racing from the face of India and it may not be too long unless a corrective action is immediately implemented and the GST is brought down to max 14%. We all know that illegal betting can be the worst enemy of any sport, any organization, any society and above all Government and very high taxation will exactly be the propellant for that.

Our Government has so many able, educated and intelligent leaders, especially the Finance Ministry, I don't see if the complete case along with all other aspects of employment, revenue for the Governments etc is explained in detail again they will not consider, they are bound to consider it and try we must, this being a very logical and genuine case affecting millions of Indian citizens.

As a Veteran punter having completed a "Silver Jubilee" in horse racing and now just a spectator i feel that "Horse Racing" as a sport might become bankrupt due to high taxation.Till today "SPORTS GAMBLING(READ AS MOSTLY CRICKET)" as in most other Country's is not legalized and since "Horse Racing" is the only legalized gambling sport in India it still draws punters irrespective of the returns on "Punter gambling investment".I run a sports speculation game on "Facebook" titled "Mittoo alias mittoo the poppat" and have proved that "SPORTS BETTING" is a skilled art akin in which the punter can make a decent living if systematic and disciplined in placing "SPORTS BETS".My aim is to legalize "CRICKET" and other "Sports Betting" in India."Horse Racing" is definitely a game of skill akin to "Poker" and not pure gambling and hence akin to "Stock Market Day Trading" its time the sport receives its due as a industry akin to any other Industry.

Four rates are fixed for GST Slabs so if we ask for reduction the next lesser slab is 18. No 2 or 4% is possible. So can racing survive at 18% at Bangalore or Mysore.

Unfortunately Moral Policing has become the motto of the present Regime, and the very foundation of Democracy, "By the People, Of the People and For the People" is getting buried along with the founders.

Racing is a negligible aspect. Look at the other aspects of life. Common mans freedom is slowly being eroded.

We were proud of our leaders when they said they took revenge with a surgical strike on enemy country and killed several terrorists. OK we believed Ache Din Aa gaya. What is happening after that the enemy country, their soldiers, their pet terrorists breached our border several times and killed more than 100 including our soldiers. Ache Din Aa gaya..?

In my entire life I have not seen such a worse situation in Kashmir, where kids, male and female students stoning Indian soldiers, at least that is what we are reading in newspapers.

There was a time we kept our money at our home. All of a sudden they declared big currencies cancelled ordinary citizens lost their hard earned money. Now they are telling we should make all transactions digital. Digital payment facilitating companies are mushrooming and hapless citizens have to pay commission and service charges to Banks as well as PayTm, Wallet like services. You can imagine who are making money from demonetisation and digitalisation of transactions.

Now this, increasing the Tax in horse racing betting made life uneasy for us, especially the the persons involved in horse racing industry.

You can narrate such so many stories which affect the common man. India is not shining, India is melting.... !

On homepage I see R.Surender Reddy talk '' Supreme Court has judged Horse Racing to be a game of Skill and not gambling '' What a joke!!
Everyone, even one knows that It's pure gambling!! Is this game of skill?? Where BeSafe is pulled near the winning point?

Where One P.Shroffs Horse ( Starts with M) is not ridden to merit and loses by lengths to another Shroffs horse..

Where we have GOWDAS, SINGHS,QUINNS who can twist and turn the game as they want!!

Is this called Skill??

We all are of the samw view but what is done is done.

SOme say go to the courts on what basis Quoting horse racing is a sport no one is denying but please see clearly the gst is ''ON BETTING''.

So if 20% [mum] existing was not challenged how can you do it now.Ther govt has just increased it.that is all

As it is the insurance and the telecom sector is crying foul[it effects crores] as against one lakh or so in racing.

So we have to live with it and adjust accordingly. The breeders are themselves to blame for the glut in the market against 40 odd stallions 15 yrs back now we have over 130 stallions! the market has remained the same.they never saw it or even try to understand this

Racing is there and will remain there,with hardships along with it.Some of us are always there some may fade away.

MYS and BTC have to work out their way of working as they are hard hit

We Indians are paying high price for petrol when its price in international markets is at its lowest points. This affects every household and business. Against this backdrop race clubs cannot expect to be treated kindly. Well, we are experiencing "acche din." It could have been far worse or could be in the coming years. Let us continue to be mesmerised by the specious oratory skills of fabricators who are trying to fool all the people all the time.

Its a sport related to gambling and i dont see any wrong doing by arun jaitley.Normal office going citizens do not care for race gambling so all clubs should stop sheding crocodile tears.

This Govt. Promised Acche Dinn. We All Got Trapped n Fooled In Their Acche Dinn Promise. Acche Dinn Are Faaar, They Even Not Able To Give A Single Accha Moment To A common Man. Since They Have Started, They Always Pushed and Pinned Down The Common Man To The X-Treme.
Did Not Even Wish n Think Of Any Accha From These Jokers.

This much is certain. The 1 lakh strong team among the 128 cr will feel fleeced & cheated in what could be the most unpopular decision by the present Central Government to those one lakh.

Let us expect some one will drill some common sense in to the head of Arun Jatley. That is the only hope, however far fetched it may sound.

Speaking harsh realities, 28% gst & 7% club charges mean 13/- dividend for a even money favorite, 19/- to 20/- dividend for 2/1 horse.

The only saving grace will be treble & jackpot pools. Till now it was 45% deduction from the sales. That may get reduced to 35% to 40%.

O K. No worries for the time being. Let us enjoy betting at the prevailing tax rate till June 30. (41 days from today, out of which 26 will be race days).

A very high level of optimism from your side. OK. There are some speakers from the turf club who are trying to reassure us by arguing on the same lines. So, you are definitely in good company. In any case, it is always desirable that some weightage is given to those who expect something called 'fairness & reasonableness' from the Government.

From my side the best scenario: the clubs will lower the betting commission to 5% or below.

One more thing where clubs will play game to save the game...that is input tax credit...means when clubs do expenditure the tax paid on them by the seller to club then that amount will be exempted..ex: if club purchases say 1cr products then the seller pays gst on them say 15 lakhs..this 1 crore is exempted from gst of club..so club purchases services 50 crores in a year then club need to pay gst for this 50 crores thus saving 3 to 4 percent overall gst paid...so effectively club may indulge 25 percent including their commission which is not bad..this is the case for if gst is on betting ticket...if gst on club commission then overall deduction may fall at 10 percent which is huge gain for all ..

I feel the GST here in on the service ie the commission the club charges, and hence it will not affect the racing. It may be noted that betting is neither goods nor service, the service is the commission charged by the
club and hence clarification may be sought from the authorities.

You are getting the facts wrong.

A horse is not owned like you own a car. You would expect some returns from it, and that ultimately boils down to the revenue generated by the clubs from the betting public.

I understand you are a owner. Maybe you can afford to race your horse against other just for the fun of it without any prize money, but for how long ??

I do agree 28 % Tax is very high but that is on gambling activity. Live Horses have been put at 12 % GST rates. which can be useful to make this industry affordable to common people.Exclusive Industry can be made affordable to middle class and it will change the industry consdierably.

An excellent write up .Please ask Mr Vivek jain what he did and his statement after the meet Mr Jaitely gave us a sympethic hearing! God knows what would have been other wise.No further slab to go on after 28 %

Please be rest assured nothing will change.
Ths govt has shown its stubborness to change any thing [Censor Mr Pankaj ,film institute, Mr Chouhan are best examples]

So now The TAI must earn its free lunches/dinners on invitation weekend sit down with all turf clubs and decide their future course of action..

Let us in the meantime enjoy till 30 June.Dark days ahead specially for the breeders.Who will now buy horses?
