Few Horse Talkers were making so much HANGAMA against 350 Members and also against "inept Chairman and his Committee Member". I have repeatedly said in HT that the demand of the Government cannot be justified and the Club will approach the Court. As per the latest report the Resolution for giving 50 membership to the Government Nominees was defeated with a majority voters voting against it, and my views are vindicated. What happened to Racing Journalists writing against the reality and were dreaming of a solution according to their wisdom?
Definitely the High Court will hear the grievances of the Club, and hope the Court will reinstate the status quo immediately. Whatever damage done by an elected government to Horse Racing in Bangalore cannot be forgotten easily.

The resolution was defeated by a majority vote against giving 50 memberships to the Govt of Karnataka. The BTC shall be approaching the Hon’ble High Court & filing a Writ Petition on November 16, 2017 for restoring the license to race & maintaining status quo.

There were lot of debate on this issue, few articles were written and published in Indiarace.com and other media by well known personalities of the racing industry. One Warring group created the issue, the other group tried to douse the matter giving detailed explanation. There is no dope whatsoever according to them, and the drug traced was within the permissible limit. So that is not a contentious issue any more. Any claims, counter claims or bogus accusations wont sustain anywhere even in a Court of Law. So Niel Darashah will train his horses as usual and he is not going anywhere !

There is a buzz in DRC that bangalore races will start in December. the members are confident of getting a stay on not renewing the licence. Some even said that banglore races will start from 1st monday of december.

I think the owners got the news in advance before the Special General Body Meeting of the BTC on 15th that BTC will file a WP in the High Court. That is the reason they requested the Court to interfere on 15th itself. May be they want to add the fuel in this case or join BTC as a stake holder to fight against the Governent. BTC may have filed their WP on 16th. Let us see how many more joining the brigade. Nothing new in it, small owners will find it difficult to maintain their horses. Since Animal Welfare Board has taken up the matter with the BTC sought reply from them pertaining to the welfare of 950 horses stationed at BTC, the owners may have panicked because AWB has jumped on their throat.

When I written that post on Nov.1, 2017, it is true I mentioned "Mysore Race Club's license to conduct races and off-course betting is expiring this month. And if they approach for renewal, there is a chance the Karnataka Government may ask them to expand the membership base. If so it is certain that the Government will demand to induct their nominees as members. If not they budge, MyRC will also follow the fate of BTC". But that was not correct. They took the license for both the seasons together (Summer and Winter) hence they will continue their activities.
Now let us see what will happen after winter season? They have to approach the Government for renewal. Is it possible TWO DIFFERENT RULES for TWO DIFFERENT RACE CLUBS in KARNATAKA..? Wait and watch.

So when the majority members of the BTC defeat a resolution or they want to approach the Court for justice, these Government Appointed Directors have no authority to challenge or act against it, more or less mere onlookers.
So they will only look when court takes up case and if asked what did they do in mediating no reply.

The Government may appoint not more than two persons (You say three Directors in BTC?) to hold office as directors on the Board of Directors of a company. It considers necessary to make the appointments in order TO PREVENT
the affairs of the company from (a) being conducted in a manner which is oppressive to any member of the company, or (b) being conducted in a manner which is prejudicial to the interests of the company, or (c) being conducted in a manner which is prejudicial to the members/public interest.
For the purposes of reckoning two-thirds or any other proportion of the total number of directors of the company, any director or directors appointed by the Government would not be taken into account.
One of the main roles of Government-appointed directors' is that they are to serve primarily as a two way window for the Government, keeping the Government informed about the internal affairs of the company, and serving to communicate the Government's view to the Board of Directors.
Please note the Government appointed directors are not given adequate powers
to exercise a significant-influence on the decisions of the company, or any decisions taken or any resolutions passed or defeated by majority members in any General Body Meeting.
So when the majority members of the BTC defeat a resolution or they want to approach the Court for justice, these Government Appointed Directors have no authority to challenge or act against it, more or less mere onlookers.

BTC most probably will seek restoration of status quo as prevailing prior to Sept 2017,on varios grounds,.Till such time the ongoing CID enquiry is completed and necessary action is taken through the judical route.Pendency of the said probe and the completion of the case cannot be a reason for suspension of racing,which goes against the spirit and tenets of natural justice.
As already stated by the Government, the inclusion of 50 Government nominees as members is not an issue,neither have they specified in writing to B T C other reasons for suspension of racing.
Just thinking out loud, am not legally qualified and may be drifting alarmingly to the outside rail.
But then you never know, may still win !

this all started with the doping case of queen latifah and its trainers n owners involement was the begining of all these unwanted episodes they have themselves opened the door for the govt to get in and surely govt will twist their muscle.i am no member of btc but they should cleaned up such trainers n owners much earlier to avoid such dirty episodes.its good that the court will decide but if its in favour of the club btc should 1st bane trainers n owners from their premises,

The government of Karnataka may now seek a speedy hearing in the SLP asking BTC to vacate the race course and hand over the land and building. The traffic and pollution levels have increased considerably and the same land will act as lung space with a massive garden in the lines of central park New York
The club members in their arrogance may have shot themselves in the leg.

ALL this has happened because of the previous Chairman and his team of stewards.
The BTC should take action on them.How did they give a letter to the GOVT. promising them 50 members free?
After doing a turnover of 2000/crores they have shown a loss of 7 crores,
Where has all the money gone? The CID report will show all their manipulations. Many arrests will be made shortly.

BTC is paying for everything. This is a subject concerning the Clubs members. They are the best judge to face the situation. Why should you or me or any punter or any other non-stake holders bother about it? Are they coming to us or going for a crowd funding to meet the legal expenses? They have the source to meet any eventuality. It is none of our business. If the Club make profit or loss that also none of our business. Punters should be concerned only the money in his pocket.
Understand Mister GR, this land is not the "personal property" of any one, or any other Bureaucrats. The matter (by way of an SLP) is already before the Hon'ble Supreme Court for hearing and Hon'ble SC will pass the orders after hearing the concerned parties. While admitting the SLP the Court has ordered the Government to maintain the status quo and allow BTC to conduct races and off course betting. Since BTC is shortly approaching High Court by way of Writ Petition, the Hon'ble Court will decide whatever the Government done is correct or contempt of court to interrupt the activities of BTC.
Mr.GR, do you know Bangalore High Court has already passed an order in favour of the Karnataka Government and asked BTC to vacate immediately. The present SLP pending before the Supreme Court is against this Order. Since SC accepted the SLP and ordered to maintain the status quo, why cant the govt wait till SC complete the hearing and pass orders?, Why the Government interfere on one pretext or another when the matter is sub-judice.

Mad Max are the members going to pay the legal fee for the case from their pocket or money collected from punters lying idle in the race course. You know how many crores was spent for obtaining a stay on land issue. Did the 350 members even one of them speak and ask the casual workers and tote staff their greviances. No. No one cared. Will any government like to be let down. No. First thing Cm will instruct the stay to be lifted for ownership of land and take it back as no racing activity is being held. Where is the question of High Court or any court hearing a petition to get license back.

Obtaining the stay from the Court looked made easy. Who will be the licensing authority. Probably employees of race course has much better claim, for the cancellation deprives them of their legitimate case to earn their livelihood. Hope both the govt & the members who strongly believe that it was their prerogative, will climbdown few steps and ensure that racing goes on as usual.

Wishful thinking more than logic seems to be with some here.
They are forgetting one simple fact.
It is one of the committee members who wrote to the govt against drug abuse. This is a sword hanging over BTC.
No court will entertain a tainted subject like drug abuse invovled.

I am quite sure that Justice will be done to the Racing in Bangalore soon.
Our BTC was made to undergo all these hardships due to their Karma !!!!
They refused to pay the Royalty to RWITC and did not give permission to the Auditors etc., Look at the way canteen is provided to the punters at BTC !
They treated punters as untouchables !!! They forgot that their very survival is based on Punters money and support only !! Now that punishment is over and they will be released from their Karmic efforts soon !! Since they did not learn a lesson themselves they were made to learn by the Almighty !!

After all Racing is Gambling with fixing doping as a part of the game to dupe Millions of Family ,In short it is a slow poison worst than the Drugs and u expect our High Court to rule in favour of few Rich Bookies benefits or Racing addicts ?????? A decade ago there was Matka and hooch employing lacs but destroying the poors family and making few such businessmen Raatoraat Rangila Ratan Richie Rich so Employing 1000 and making Million pauper is not Natural Justice. Take it in lighter vein as Transparency believes in De Na for free cheers to All.
