The High Court of Karnataka on Friday ordered issue of notice to the State government and Bangalore Turf Club (BTC) on a petition filed by 10 race horse owners seeking directions to the authorities to restart horse racing at the BTC by renewing the licence for racing.
Justice A.S. Bopanna passed the order on a petition filed by H.S. Chandre Gowda and nine other owners of horses that are among the 1,300 horses in the stables of the BTC.
Claiming that they do not know for what reason the racing licence of the BTC has not been renewed from September 1, 2017, the petitioners stated that non-renewal of licence had brought their avocation to a standstill and they had not been able to earn their livelihood by collecting the stake amount that each horse owner gets depending upon the results of horse race.
Ponting out that the BTC collects a basic training fee of ?22,500 a month per horse, the petitioners said the winter horse racing, which was scheduled to begin in the first week of November, had not yet commenced and this had resulted in severe monetary loss to the club as well as to the horse owners.
The financial crisis, the petitioners claimed, would shortly lead to withdrawal of incentives, subsidies and revolving credit facilities for the upkeep and maintenance of thoroughbred race horses, and such a situation would lead to decline in quality and quantity of feed supplied to horses, availability of medical support, etc. at the BTC.
The financial crisis would also result in loss of jobs to trainers, jockeys and others at the BTC, the petitioners said.
Non-renewal of licence of the BTC by the State authorities was discriminatory in nature as the State had renewed the licence of Mysore Turf Club, the petitioners claimed while complaining that the BTC too had failed to discharge its duty to secure renewal of licence as per the club’s articles of association and memorandum of association.
The government was earning a revenue of about ?600 crore a year from the BTC, which has an annual turnover of around ?2,500 crore to ?3,000 crore, it was claimed in the petition.

Now you are enlightened... but in your earlier comments...you said "the Hon"ble Court had issued the Notice to know the facts and Circumstances from the Club as well the State and Since Doping and Malpractice in Conducting Racing is still under Investigation, the Matter is subjudice".

Dear Mad Max the word sub judice refer to a Matter before Court ,under consideration and not yet decided . Once the Court gives Order then it is not sub judice till Any Appeal is filed so I think ur mistaken in deciphering and There is no intent of any insult if posting the facts . No doubt Many of U r hoping but the Reality is Case Not yet decided so Gud Night Shabba khair .

Hope is a feeling of optimistic mind based on expectation and desire for a particular thing to happen. And majority of racing enthusiasts expecting a positive solution come from the Hon'ble High Court, Bangalore.
Writ Petition filed by BTC has been already listed by the High Court of Bangalore, to be heard on Monday 20th November 2017. Until and unless the Court heard both parties, nothing is clear. State Government is optimistic. Same time BTC and its members, Owners, Trainers, Jockeys, are also optimistic. Till the other day I was wondering why the Club was not moving to the Court? Since the matter has been already reached there, I am double optimistic.

Any case filed by BTC or horse owners should have been before expiry of license even by one day. This would have given advantage if hon.court ordered status quo to be maintained thereby giving life to license!.

NO man you are wrong, that matter is under investigation, that case is not filed before any Court of Law, so the matter is not subjudice. Cases under police investigation, or CBI investigations are discussed and debated publicly by TV Channels because such cases are not subjudice.
Then what is SUBJUDICE ? Any case under trial or hearing is sub judice.
Sub-judice means "under judgment", "considered for judgement", or "Cases under trial", or "Cases admitted in the Court for hearing". Public cannot initiate discussion or debate on such cases, because as per law it is inappropriate to comment publicly on cases subjudice. That is an offence leading to contempt of Court proceedings because it is viewed as interference in court proceedings. The Special Leave Petition (SLP) of The KROA filed before the Hon'ble Supreme Court is subjudice. Because the Hon'ble Court admitted the SLP for hearing.

Hope u know that There was also a Court case in respect of Maggie Noodle regarding some objectionable ingredients and it was banned till the Reports came clear even though during the period many were unemployed as In North East State Many People r in the business of selling Maggie Noodle on the Roads and mainly staple food of many children as well .So Dont rush to conclusion that Hon"ble Court had granted permission to Start Racing without licence especially when there is also an Appeal pending between BTC vs State .In short the matter is subjudice .

Mock races is a good sign, But one hates to see the govt. take a negative stand. in the courts. After all they also are losing money on tax.

Story not ended there ! At the instance of owners who defeated the resolution, BTC may also have filed a Writ Petition by now in the High Court, which is also coming up for hearing ! There is a law in the land to awake the sleepers.

There are so many Horse Talkers and supporting few Racing Journalists who were misreporting the facts and pressurizing the Members. These gentle(?) reporters were of the opinion that there is no escape route for the BTC. In their words, BTC is almost down their shutters. After High Court's notice to BTC and the Government yesterday itself, my repeated views (Needs Court's Intervention) on the topic are vindicated. Hope the detractors rest their 10 fingers in in pants' torn pockets.
