Racing To Return To Btc In December Before Christmas

The Hon'ble High court have asked the Karnataka government to appoint a committee to administer the racing activities at BTC till the Writ Petition is decided. The Court has taken the initiative to resolve all evils of the Club in its true perspective and asked the Government to come back with their reply on December 12.

I am of the opinion that the Court is giving short dates, Nov. 23, Nov 28, Dec. 4, Dec. 12, it shows the Judge has viewed the present tribulations seriously and wanted to bypass the arrogant members of the BTC who are dominating and interfering in the affairs of the Club, at least till the WP is disposed off.

The State Government have got a golden opportunity to solve their created ambiguous situation, as they are loosing a regular income, support of the public, hence they may take a wise decision - Kill not the goose that lays golden eggs.

Am I correct when I say in a similar situation races were conducted for some time by Department of Racing of TN government.If I remember it was when Supreme Court passed interim orders.

I showed this decision to a lawyer friend of mine.

Clearly BTC has lost the plot and the right to run races in BNG.

Now a govt appt. lot will run the show where does that leave the BTC and its 350 members.

There is no mention of BTC in the order.

M.M please for heavens sake stop being personal and stick to the subject,yourcomments of keeping 50 in ones home has no relevance here

It is the Court think see the entire sentence I written..." it shows the Judge has viewed the present tribulations seriously and wanted to bypass the arrogant members. Yes the Court will definitely weigh the things as per the Government's narrative, and they wanted to sideline the people who influence the owners "to do this, to do that, etc".

@ To my detractors,

I have posted the title thread "Racing to return to BTC in December before Christmas" was mainly to grab the attention of the followers of the game. Secondly, any optimistic writer will present the subject that way only and I have done the same. If you read the entire lead post, never I repeated "Racing will return before Christmas'. The readers may have felt cheated for me not touching TITLE SUBJECT in my write up? Simply, when the matter is in the Court, and the Court reacted positively on 4th Dec., no sensible man will say Govt will pull the shutters of BTC. Whether the races will restart in December or January, that is not in our hands, like, to win or lose a race, that is not in our hands, our job is to speculate after analyzing the available facts.

If a committe is formed then where to BTC stewards stand when they are required. This is not cricket where a COA was formed to oversee BCCI and no legal betting is involved in cricket unlike racing. All know how stewards and members all over India in all clubs have they set of trainers and jockey's who they can get info. One side they is a set of members who never want racing back at any cost. Other side you have the government who will go to any length to see racing is not started till BTC tow their line. In the middle are we punters and syces and staff who don't care of all these things.

Are you ready to accommodate 50 race punters at your home on all race days, with boarding and lodging? Otherwise, leave it, are you ready to give space for them to fresh up on any single race day?

No stake holders can give whatever free lecture they want... take it, give it etc., but in reality when it comes to affect us, we will go back from our words. That is the reason in my every comments I support the Club, who am I to support the Governments or their 50 Bureaucrats wanted to become members?

All details available and written by Ikram Khan. BTC seems to be in a hurry always without thinking. Apply licnese in wrong format then go for WP. Let's realise that Advocate General is arguing for government's side. Even if BTC members agreed to give 50 members without voting rights as special case against some fee let's say 5 lakhs by now government would have agreed.

The High Court has said that the possibility of holding horse racing in this season at the Bangalore Turf Club should be looked into. On Monday Justice AS Bopanna was hearing a batch of petitions, seeking holding of races. The State Government has withheld permission for the races this season.

The HC said that the interest of all stake holders should be considered. In an interim order on Monday it said "Having heard the Senior Counsel for the Petitioners and also the Advocate General at some length and since a further consideration herein would be required, what is also necessary to be kept in view at this point is the interest of all stakeholders and in that view, it is necessary to explore the possibility of having an interim arrangement during the pendancy of this petition"

The Court said the possibility of a committee to supervise the races for this season should be considered.

It said "Keeping in view that the racing season would be for a limited period, the possibility of holding the horse race during the current season on the supervision of a Committee to be appointed specially for this purpose, is also a possibility which is required to be looked into".

The Government has been asked to reply about the possibility in this regard. The High Court said "An interim arrangement could be worked out in this regard".

The Advocate General will report to the Court about the Government's decision in the next date of hearing on December 12.

Mr.Mad Max shall we all celeberate with your confirmed news. Shall we tell all the staff and syces and all punters that according to Mad Max racing to start before Christmas. What you mean the state government have a golden opportunity to solve this. If they were worried about tax or income they would have not played with racing like this. Please write as a punter.

We all are keen for racing but there is a catch to the ruling as S.T.punter has pointed out.

It may not be that early I fail to understand the BTC lawyer, why did he not ask for off course betting to be allowed.

Court has only asked to consider and not as mentioned that asked to appoint a committee. It is govt's prerogative.

If you know the Judiciary in India, the pattern of judgements given by Bangalore, Bombay, Hyderabad, and Madras High Courts more or less same. These 4 Courts very rarely go against the Government, unlike Allahabad, Patna,Calcutta High courts which will readily give a stay, on the drop of a Hat.

An English proverb says - You can drag a Horse to a Tank but you can not make the Horse to drink the water !!!!
Here Horse is the adamant Govt. Hon'ble High Court can give guidance or directive by if the Govt. is adamant nothing can be done. But if the Hon'ble Court observes that the Govt. is still adamant in spite of their gesture thgen things will take differemt shape.

High Court did not give a directive. High Court only asked the Karnataka Govt, to consider appointing a committee. Govt could argue, it is not in best interest to consider, when a CID report is awaited. What will the Court do then?

Where is it mentioned that before Christmas it will resume races in BTC.

Stop misleading and speculating... Till decision comes .. No one can guess the JUDGEMENT
